These terms and conditions outline the rules and regulations for the use of the Cardano Beam website, located at https://cardanobeam.app, and the Cardano Beam Mobile App, downloadable from the Google Play and Apple Store

By accessing this website and using the Cardano Beam Mobile App we assume you accept these terms and conditions. Do not continue to use CardanoBeam, if you do not agree to take all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions Agreements: “Client”, “You” and “Your” refers to you, the person log on this website and compliant to the Company's terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client's needs in respect of the provision of the Company's stated services, in accordance with and subject to, prevailing law of Portugal. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same

Services

Cardano Beam provides the following services:

  • Localisation service of users through the use of mobile devices
  • Displaying and listing Events as submitted by the Event organiser, promoter, producer, presenter, or manager
  • A ticketing service where users of mobile devices purchase tickets to, and attend Events organised by Cardano Beam, Dynamic Strategies, and/or its affiliates

Ticket Purchase Agreement

Each ticket that You purchase is a limited license to attend a particular Event, and is subject to the additional terms and/or restrictions that may be set forth on that ticket. The parties, intending to be legally bound, hereby agree as follows:

By clicking “Pay”, or “Check”, you represent that you have read and understand this agreement and the privacy policy, each hereby incorporated by reference, and expressly agree to, and consent to be bound by, all of the terms and conditions contained therein. This agreement shall have the same legal effect and force as a written and signed document. If you do not agree to all of the terms and conditions, we will promptly cancel this transaction and you will be unable to access the bigtickets.com website and the services that it offers. We reserve the right to decline your request for services for any reason and without notice.

Ticket Pricing and Availability

The Organizer, in its sole discretion, determines factors such as ticket pricing, availability, availability of individual refunds where an event has not been cancelled, and seating locations. Tickets may be sold exclusively through Us or in combination with other inventories from companies not associated with Us. We have no control or authority over the Organizer, ticket prices, availability, seating locations, individual refunds, or any other companies which may be selling tickets to the Events listed on Our website.

Ticket Payment and Service Charges

When you pay for tickets through Cardano Beam, we accept several methods of payment, including but not limited to: Visa, MasterCard, Discover, American Express and such other payment methods as are permitted by an Organizer. Any tickets purchased on Our website applications are subject to a per-ticket service charge, as shown prior to the time of Your ticket purchase, and, when You pay for Your tickets through Cardano Beam We charge a payment processing fee and, if applicable, a refund processing fee (such per-ticket service charge, payment processing and refund fees collectively, “Fees”)

Ticket Limits

You will be limited to a certain number of tickets for each Event. The Event listing will contain the maximum number of tickets available to each purchaser, and this number will be verified for each transaction. This policy is intended to discourage other purchasers from engaging in unfair trade practices.

No Refunds or Exchanges for Event Restrictions or Lost or Stolen Tickets

Before purchasing Your tickets, it is Your responsibility to carefully review all aspects of the Event, Event restrictions, if any (see the paragraph titled “Event Restrictions” for more information), dates, pricing, charges, and seat selection. We will NOT issue any refunds or exchanges because You failed to review this information and We will not issue any refunds for any lost, stolen, destroyed, or damaged tickets, or as under any other circumstances except in the limited cases explicitly described in this Agreement. As previously stated, even if a refund is issued by Cardano Beam, Our Fees will be deducted from the refund amount.

Ticket Delivery

Your ticket will be delivered to the address you specified when purchased the ticket. The ticket will be delivered in digital form. These tickets will generate a unique QR code corresponding to Your ticket and your address, which the Event organiser might request you to show at the Event.

Event Admittance

You understand that You must bring the ticket in the Cardano Beam Mobile app with You to the Even and generate the QR code from the Cardano Beam Mobile app. Printed QR codes will not be accepted. Additionally, while not all Events require identification, on some occasions, government-issued identification will be required by the Organizer. For this reason, We recommend that You bring a valid and current government-issued photo identification (“ID”) with You to the Event. When arriving at an Event, there will only be one entry per ticket. If there are multiple parties attempting to enter using the same ticket, only the first party that arrived with the ticket will be admitted.

Event Restrictions

Some Events listed on Our website may have certain restrictions. For example, some Events will only admit people over twenty-one (21) years of age or must have a certain affiliation, such as being a student at a particular educational institution. It is Your responsibility to determine if a particular Event restriction applies to You (and Your party, if applicable) and to fulfill all criteria in order to gain admittance. No refunds will be given if You are declined entry to an Event due to a restriction.

Cancelled or Rescheduled Event

Occasionally, an Event is cancelled or postponed by the Organizer due to weather or other unforeseen circumstances. In certain instances, We may also cancel an Event due to problems with the Organizer or the Event listing. If an Event is cancelled, We may post a notice of cancellation on Our Website under the Event listing promptly after We receive notice of the cancellation or otherwise attempt to notify You. If this happens, and if You have paid Cardano Beam directly for Your ticket, you will receive a refund. If You learn that an Event is cancelled, moved, or rescheduled, please contact Us at Our customer support address set forth below for information on receiving a refund

Where you have paid for Your ticket through Cardano Beam, any refunds issued to You will be provided only after Our receipt of payment of the refunded amount from the Payment partner handling the payment transactions. Any refund issued by Cardano Beam will be applied to the credit or debit card or other payment account You used to purchase Your ticket; Cardano Beam shall not be responsible if you fail to receive Your refund because your account information on file with Cardano Beam, or its payment partners is no longer valid or up-to-date. Any refunds of Cardano Beam Fees will not be included in a refund from Us. Cardano Beam does not assume responsibility to make refunds to any person other than the person who ordered the tickets as shown by Our records, regardless of whether or not the tickets purchased by You have been transferred in accordance with these Terms and Conditions.

Ticket Transfer

If an Organizer permits it, Tickets purchased by You may be transferred to other parties. If you are purchasing tickets for Yourself and on behalf of other parties, You, as the primary ticket holder, may resell or transfer these tickets to the other parties. When arriving at an event, there will only be one entry provided per ticket. If there are multiple parties attempting to enter using the same ticket, only the first party that arrived with the ticket will be admitted. It is Your sole responsibility to comply with any applicable local laws that relate to the resale, transfer, or other disposition of tickets. You are solely responsible, as well, for ensuring that any transferees of Your tickets are eligible to attend the Event and comply with any applicable restrictions for the Event (e.g., age restrictions). Neither this Agreement nor the Terms and Conditions is intended to create any third-party beneficiary rights for transferees of tickets, and You agree to indemnify, defend and hold Cardano Beam, its affiliates, and its and their employees and customers harmless from and against any and all claims, suits, complaints, actions, demands, proceedings, damages, losses, liabilities, costs and expenses incurred, suffered, brought, claimed, made or alleged by or on behalf of any transferees of tickets, as well as any and all attorneys’ fees and other costs or expenses incurred by Cardano Beam or any of the other indemnified parties in connection therewith. For tickets for Events sold by Cardano Beam, tickets purchased from any party other than Cardano Beam carry a great risk of being fraudulent.

Limitation of Liability

You understand and acknowledge that Cardano Beam is a provider of ticketing services only, is not an organiser or other promoter of any event listed on our website, and has no responsibility for or control over the conduct of the event (or the operation, management or condition of the venue in which the event is held). You assume all risks, losses and liabilities incidental or related to the event for which a ticket is issued, whether before, during or after such event, and you waive any claims for personal injury, death, property loss or any other damage against Cardano Beam arising out of or in any way relating to such event.

Ticket Restrictions

Organisers reserve the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct is deemed disorderly, who uses vulgar or abusive language or who fails to comply with the Organisers rules, including any requirement that persons not record or transmit any picture or reproduction of the Event. You and Your belongings may be searched on entry to an Event. Breach of terms or rules will terminate Your license to attend the Event without a refund. A ticket is a revocable license and admission may be refused upon refunding the ticket’s face amount. A ticket is not redeemable for cash.

Independent Contractors

Cardano Beam and You are and shall be independent contractors. Neither party by virtue of this Agreement, shall have any right, power, or authority to act or create any obligation, express or implied, on behalf of the other.

License

Unless otherwise stated, Dynamic Strategies and/or its licensors own the intellectual property rights for all material on the Cardano Beam website. All intellectual property rights are reserved. You may access this from CardanoBeam for your own personal use, subjected to restrictions set in these terms and conditions.

You must not:

  • Republish material from Cardano Beam
  • Sell, rent or sub-license material from Cardano Beam
  • Reproduce, duplicate or copy material from Cardano Beam
  • Redistribute content from Cardano Beam

Content Liability

We shall not be held responsible for any content that appears on your Website. You agree to protect and defend us against all claims that is rising on your Website. No link(s) should appear on any Website that may be interpreted as libellous, obscene or criminal or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

Prohibited Content

Any content or other material that (a) violates any applicable law or regulation, including the criminal code, data protection, consumer law and youth protection provisions, or infringes any Third Party rights, including any Third Party Intellectual Property Rights; (b) is obscene, sexually explicit or defamatory, or related to sex trafficking; (c) contains depictions of violence or is threatening or harassing; (d) contains viruses, spyware, adware, pirated software, digital rights protection circumvention or hacking tools, spamming tools or any other harmful code or activity that could, in an impermissible manner, access or use, impair or injure any data, devices, computer systems, or software; (e) is false, misleading or deceptive; (f) includes references to gambling, alcohol, tobacco, drugs, or firearms, including without limitation ammunitions, fireworks and explosives; (g) endorses or encourages violence, hatred, revenge, racism, sexism, victimization, or discrimination of any kind; (h) results in consumer fraud, product liability, or breach of contract to which Demand Partner is a party, or causes injury to any Third Party; or (i) promotes any products and services that fall within any of the foregoing categories (a) to (h), or promotes any company, organization, person or brand that engages in or is associated with any of the conduct described in the foregoing categories (a) to (h).

Content that falls under the following categories is prohibited on our Website and is subject to removal without notice:

  • Cartoon or Fantasy Violence
  • Realistic Violence
  • Prolonged Graphic or Sadistic Realistic Violence
  • Profanity or Crude Humor
  • Mature/Suggestive Themes
  • Horror/Fear Themes
  • Medical/Treatment Information
  • Alcohol, Tobacco, or Drug Use or References
  • Simulated Gambling
  • Sexual Content or Nudity
  • Graphic Sexual Content and Nudity

Reservation of Rights

We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately removing all links to our Website upon request. We also reserve the right to amend these terms and conditions, and its linking policy at any time. By continuously linking to our Website, you agree to be bound to and follow these linking terms and conditions.
